Bluestone is a natural material quarried from the earth. Each piece is unique with inherent variations including:Color Variations:

• Ranging from blue-gray, gray, lilac, to brown and rust tones
• Color may change with weathering and exposure
• Thermal (flamed) and natural cleft finishes may display different colors

Physical Characteristics:

• Natural veining, striations, and mineral deposits
• Surface texture variations
• Dimensional tolerances per industry standards
• Density and porosity variations
• Natural fissures, pitting, or iron deposits

Grades and Quality:

• We offer various grades of bluestone (select, standard, rustic, etc.)
• Grade descriptions are guidelines; some variation within grades is normal
• Not all quarried stone meets the same specifications

By purchasing bluestone products, you acknowledge and accept these natural variations as inherent characteristics, not defects.

• Stone availability depends on active quarrying operations and inventory
• Certain colors, sizes, or characteristics may be temporarily or permanently unavailable
• We cannot guarantee exact matching of previously purchased materials due to natural geological variations
• Quarry conditions, weather, and geological factors may affect production schedules

• All prices are listed in [Currency] and are subject to change without notice
• Retail prices are published on the Site; wholesale prices are provided to approved accounts
• Prices do not include shipping, handling, fabrication fees, taxes, or other charges unless specifically stated
• We reserve the right to correct pricing errors and cancel orders placed at incorrect prices

Retail Customers:

• Payment is required at the time of order placement unless otherwise arranged

Wholesale Customers:

• Credit limits are assigned based on creditworthiness
• Late payments may incur interest charges and suspension of account privileges
• We reserve the right to require prepayment or secure payment for any order

• Custom fabrication orders require a non-refundable deposit (typically 50%)
• Deposits are applied to the final invoice
• Balance is due upon completion and before shipment
• Deposits are forfeited if orders are cancelled after fabrication begins

Applicable sales taxes will be calculated and added to your order based on your location and local tax regulations. Wholesale customers with valid resale certificates must provide documentation to qualify for tax exemption.

When you place an order, you are making an offer to purchase products subject to these Terms. We reserve the right to:

• Accept or decline your order for any reason
• Require additional verification or documentation before processing orders
• Limit quantities available for purchase
• Cancel orders that appear fraudulent, suspicious, or violate our policies

Stock Products:

• Pre-cut standard sizes available for immediate or near-term delivery
• Subject to current inventory availability
• May have slight dimensional variations within industry tolerances

Custom Orders:

• Require detailed specifications, measurements, and finish requirements
• Lead times vary based on complexity and current production schedule
• Require customer approval of specifications and shop drawings before production
• Are non-refundable once fabrication begins
• May require site measurements or templates

Our fabrication capabilities include:

• Surface treatments (thermal/flamed, honed, polished, natural cleft)
• Drilling and specialty cuts

Fabrication specifications must be provided in writing. We are not responsible for errors in customer-provided measurements or specifications.

• Shipping costs are calculated based on weight, dimensions, distance, and delivery requirements
• Delivery timeframes are estimates and not guaranteed
• We work with specialized freight carriers experienced in handling natural stone

Retail Deliveries:

• Curbside delivery to accessible locations
• Inside delivery or specific placement may be available for additional fees
• Customer is responsible for unloading unless other arrangements are made
• Delivery appointments must be scheduled in advance

Wholesale Deliveries:

• Delivery terms negotiated based on order size and frequency
• May include freight-on-board (FOB) origin or destination options
• Scheduled deliveries for regular wholesale customers
• Will-call pickup available at our facility

• Customers may pick up orders at our facility by appointment
• Customer is responsible for proper equipment, securing loads, and safe transport
• We can assist with loading using our equipment
• Customer assumes all risk upon loading

You must inspect all products immediately upon delivery. Claims for shipping damage, shortages, or defects must be reported within 48 hours of receipt with photographic documentation. Failure to inspect and report issues promptly may result in denial of claims.

• Signature required for delivery
• Adequate access for delivery vehicles (including clearance for large trucks)
• Proper equipment for unloading heavy stone materials (forklift, pallet jack, etc.)
• Sufficient labor to assist with unloading if required
• We are not responsible for delays caused by inaccessible delivery locations

We warrant that our bluestone products are:

• Quarried and fabricated using industry-standard practices
• Free from manufacturing defects at the time of delivery
• Accurately cut and finished according to approved specifications (for custom orders)

This warranty does not cover:

• Natural variations in stone characteristics (color, veining, texture, mineral content)
• Damage occurring during or after installation
• Normal wear, weathering, or aging of natural stone
• Damage from improper use, storage, handling, or maintenance
• Products that have been modified, altered, or installed improperly
• Staining, etching, or damage from chemicals or environmental factors
• Dimensional variations within industry-accepted tolerances

• Fabrication defects: 30 days from delivery
• Material defects: 30 days from delivery
• Warranty applies only to the original purchaser and is non-transferable

EXCEPT AS EXPRESSLY PROVIDED ABOVE, OUR PRODUCTS AND SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.We specifically disclaim any warranties regarding:

• Exact color matching between batches or orders
• Suitability for specific applications (customer must determine appropriateness)
• Performance in specific environmental conditions
• Longevity or durability in all applications

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Butternut Ridge Bluestone, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, BUSINESS INTERRUPTION, PROJECT DELAYS, LABOR COSTS, OR LOSS OF USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, PRODUCTS, OR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR PURCHASE OF PRODUCTS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCTS GIVING RISE TO THE CLAIM.Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless Butternut Ridge Bluestone, LLC, its officers, directors, employees, agents, contractors, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:

• Your use of the Site, products, or services
• Your violation of these Terms
• Your violation of any rights of another party
• Improper installation or use of our products
• Your negligence or willful misconduct
• Resale of our products with misrepresentations or without proper disclosures

We strongly recommend professional installation of bluestone products by qualified contractors experienced with natural stone. Improper installation may:

• Void warranties
• Result in product damage or failure
• Create safety hazards
• Lead to premature wear or deterioration
• Cause injury or property damage

You are solely responsible for:

• Determining the suitability of products for your intended application

We welcome customers to visit our quarry, fabrication facility, and showroom by appointment. However:

• Children must be supervised at all times
• Photography or video recording requires prior permission
• Visitors enter at their own risk

Wholesale pricing, terms, and business arrangements are confidential. Wholesale customers agree not to:

We reserve the right to terminate wholesale accounts for:

Customers are responsible for:

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to:

• Geological conditions affecting quarrying operations
• Weather conditions preventing quarrying or delivery
• Acts of God, natural disasters, or severe weather
• Equipment failures or breakdowns
• Labor disputes or strikes
• Government actions, regulations, or permit issues
• Supply chain disruptions
• Pandemics or public health emergencies
• Utility failures or telecommunications outages

These Terms shall be governed by and construed in accordance with the laws of New York State, without regard to its conflict of law provisions.

In the event of any dispute:

1. Informal Resolution: Parties agree to first attempt to resolve disputes through good-faith negotiation
2. Mediation: If negotiation fails, disputes will be submitted to mediation before a mutually agreed mediator
3. Arbitration: If mediation fails, disputes will be settled by binding arbitration in accordance with the rules 

Any arbitration or legal proceeding shall take place in Otsego County New York State, and you consent to the exclusive jurisdiction of courts in that location.

You agree that any arbitration or proceeding shall be limited to the dispute between you and Butternut Ridge Bluestone, LLC individually. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect intellectual property rights, confidential information, or to prevent irreparable harm.

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

These Terms, together with our Privacy Policy, Return and Refund Policy, and any wholesale account agreements, constitute the entire agreement between you and Butternut Ridge Bluestone, LLC regarding your use of the Site and purchase of products, superseding any prior agreements or understandings.

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Butternut Ridge Bluestone, LLC.
